CASE STUDIES

Mr H v B Limited
Representing the Claimant: Ashley Webb

This was a case involving an employee who was required to manoeuvre large sheets of plywood up a ladder onto a roof. He was not provided with any assistance.

His previous Solicitors advised him that he did not have a case on the basis that he had a complex medical history containing contradictory references to the accident and witness evidence disputing the circumstances of the accident

Despite this we were able to settle the matter in our client’s favour prior to trial.

Burgess v Plymouth City Council [2005] EWCA CIV 1659
Representing the Claimant: John Grace

John represented a school cleaner who tripped on a sandwich box left on a classroom floor.

It was part of the schools regular routine for these boxes to be put away at the end of the day prior to the arrival of the school cleaners.  On this particular day a box had not been removed from the floor and the client who was employed as a school cleaner tripped and fell over the box.

The Court of Appeal withheld that even though it was the claimant’s job to clean the school it still imposed upon her employer an obligation and duty, as far as reasonably practical.  Therefore despite being the client’s job to clean the school her employer still had to ensure that she could do so safely.

H v P
Representing the Claimant:
Grant Fowler

This is a case in which a tree surgeon was in a tree working with a chainsaw.  Unfortunately the chainsaw came into contact with the supporting rope, cutting through it, causing our client to fall to the ground sustaining significant injuries.

There was a dispute by the Defendants insurance company as to whether the insurance company had any responsibility, but this was eventually resolved and the Defendants insurance company accepted that they had to provide insurance cover.

The case then proceeded through the Courts with the Claimant succeeding in showing that the Defendant was partially responsible for the accident occurring and as a result the Claimant recovered compensation.
