MAKING A BRAIN INJURY CLAIM

There are three main elements of any claim for compensation. You must be able to prove that:
  1. You have indeed suffered a brain injury.
  2. Another person’s actions caused that brain injury.
  3. The other person was at least partly to blame.
You should not expect your claim to be resolved quickly. Claims for compensation for brain injury can take 3 to 5 years and sometimes longer. This is because it is important to know how your brain injury is going to affect you in the future and to assess all your future needs. A delayed final settlement should not normally prevent interim payments being made.

There are three elements to the compensation that you will receive:
  1. Compensation for the injury itself.
  2. Support for you and your family, in the form of rehabilitation and treatment and also possibly counselling and cognitive therapy.
  3. Expenses, including loss of earnings, care, medical expenses and equipment.
In order to make a claim, you will need to undergo medical examinations to determine the prognosis for your injuries. Treatment needs and care requirements should also be identified at this time. You may be able to obtain rehabilitation and treatment costs from third party insurance companies even when liability is in dispute. Our team of specialist solicitors at the South West Accident Helpline will be able to guide you through every step of your claim.
